RECALL COURT VERDICT:
THE PEOPLE WIN!

(SACRAMENTO) – The Chairman of the Recall Gray Davis Committee (website: www.RecallGrayDavis.com), The Honorable Howard Kaloogian, released the following statement concerning the unanimous decision by the 11-judge panel of the 9th District Court of Appeals. The Recall Gray Davis Committee and Mr. Kaloogian joined with Bill Simon and Californians for Grassroots Leadership Committee in filing an Amicus Brief in the case.

Statement by Howard Kaloogian, Chairman, Recall Gray Davis Committee:

“Today marks yet another victory by the people of this state who support the recall of Governor Davis.

“Every step of this recall effort has been met by legal challenges initiated by those who oppose the recall. Their agenda is clear – they seek to use every means at their disposal including filing frivolous lawsuits and using illegal means to raise campaign contributions in a desperate attempt to keep Gray Davis in power.

“Their abuses speak to the very nature of why this is the first recall of a statewide elected official in California history that qualified for the ballot. I urge all Californians to support this recall effort so that we may make a real change in our state government and send a message to every politician in Sacramento that they must be responsive to the people… or else.”

Excerpt From the Amicus Brief Filed by Recall Gray Davis Committee:

“By delaying the October 7, 2003, recall election, required to be held ‘not less than 60 days nor more than 80 days from the date of certification of sufficient signatures,’ Cal. Const. Art II, sec. 15(a), the three-judge panel of this Court frustrated the will of the people of the State of California, and extended the cloud of recall that hovers over California.”
